A. General Terms and Conditions
1 Scope
1.1 These terms and conditions of "Christian Rickert" (hereinafter "Seller") apply to all contracts concluded between a consumer or entrepreneur (hereinafter "Customer") and the Seller regarding the goods and/or services presented by the Seller in its online shop. The inclusion of the Customer's own terms and conditions is hereby excluded, unless otherwise agreed.
1.2 A consumer within the meaning of these General Terms and Conditions is any natural person who enters into a legal transaction for a purpose that cannot be attributed to their commercial or independent professional activity. An entrepreneur within the meaning of these General Terms and Conditions is any natural or legal person, or a partnership with legal capacity, who, when entering into a legal transaction, acts in the exercise of their independent professional or commercial activity.
2 Conclusion of contract
2.1 The product presentations contained in the Seller's online shop do not constitute binding offers on the part of the Seller, but serve to submit a binding offer by the Customer.
2.2 The customer can submit the offer by telephone, in writing, by fax, by email, or via the online order form integrated in the seller's online shop. When placing an order via the online order form, the customer submits a legally binding contractual offer for the goods contained in the shopping cart after entering their personal data and clicking the "Submit order" button in the final step of the ordering process.
2.3 The Seller may accept the Customer's offer by issuing a written (letter) or electronic (fax or email) order confirmation or by delivering the goods within five days. The Seller reserves the right to refuse acceptance of the order.
2.4 Order processing and contact are generally carried out via email and automated order processing. The customer must ensure that the email address provided for order processing is correct, so that emails sent by the seller can be received at this address. In particular, when using spam filters, the customer must ensure that all emails sent by the seller or third parties commissioned by the seller to process the order can be delivered.
3 Return costs when exercising the right of withdrawal
The buyer is responsible for the return shipping costs.
4 Prices and payment terms
4.1 The prices stated by the Seller are final prices and include statutory German VAT. Any additional delivery and shipping costs will be stated separately in the respective product description in the offer.
4.2 For deliveries within Germany, the Seller offers the following payment options, unless otherwise stated in the respective product description in the offer:
Prepayment by bank transfer
PayPal
Credit card (service provider PayPal)
Cash on pickup
For deliveries to countries outside the European Union, additional costs may arise in individual cases for which the seller is not responsible and which must be borne by the customer. These include, for example, costs for money transfers through credit institutions (e.g., transfer fees, exchange rate fees) or import duties or taxes (e.g., customs duties).
4.3 If advance payment has been agreed, payment is due immediately after conclusion of the contract.
4.4 For self-collection, the seller will first notify the customer by email that the ordered goods are ready for collection. After receiving this email, the customer can collect the goods after consultation with the seller. In this case, no shipping costs will be charged.
5 Delivery and shipping conditions
5.1 Goods are generally delivered by post to the delivery address provided by the customer. When processing the transaction, the delivery address provided by the seller during the purchase process is decisive. Exception: If PayPal is selected as the payment method, the delivery address provided by the customer to PayPal at the time of payment is decisive.
5.2 If the transport company returns the shipped goods to the seller because delivery to the customer was not possible, the customer shall bear the costs for the unsuccessful shipment. This does not apply if the customer exercises their right of withdrawal by refusing acceptance, if they are not responsible for the circumstances leading to the impossibility of delivery, or if they were temporarily prevented from accepting the offered service, unless the seller had notified them of the service a reasonable time in advance.
6 Liability for defects
The statutory liability for defects applies.
7 Applicable law
7.1 All legal relationships between the parties shall be governed by the laws of the Federal Republic of Germany, excluding the laws governing the international sale of movable goods. For consumers, this choice of law applies only to the extent that the protection granted is not withdrawn by mandatory provisions of the law of the country in which the consumer has his or her habitual residence.
7.2 If the customer is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract shall be the Seller's registered office. The same applies if the customer does not have a general place of jurisdiction in Germany or the EU, or if their place of residence or habitual abode is unknown at the time the action is filed. The right to also bring the case before a court at another legal place of jurisdiction remains unaffected.
7.3 The contract language is German.

The essential characteristics of the goods or services are set out in the respective product description provided by the seller.
3 Information on the conclusion of the contract
The contract is concluded in accordance with Section 2 of the Seller’s General Terms and Conditions (see above).
4 Information on payment and delivery
Payment shall be made in accordance with clause 4 and delivery in accordance with clause 5 of the Seller’s General Terms and Conditions (see above).
5 Information about the technical steps leading to the conclusion of the contract
The contract is concluded by offer and acceptance.
5.1 If the customer uses the seller's online order form to place his order, he submits his offer as follows:
5.1.1 On the seller's product offer page, the customer first clicks on the "Add to cart" button.
5.1.2 Now, in the second step, the customer clicks the "Checkout" button, either directly or after placing additional items in the virtual shopping cart. The customer is now in order process 1. Here, the customer is given an overview of their order. The customer must now select the delivery country and their payment method.
If this is selected, the customer proceeds via the "Checkout" button.
5.1.3 In order process 2, the customer must register and has the following options:

I would like one-time access?
If you are already registered as a customer, you must log in with your email address and password by entering your email address in the "Email" field and your password in the "Password" field, and then clicking the "Login" button.
If he is not yet registered as a customer, he clicks on the button "I would like to register" and fills in his personal details and then clicks on "Next".
If the customer only wants guest access, they select "I want one-time access," fill out their personal details, and then click "Next."
5.1.4 In the order process 4, the customer must confirm our terms and conditions and right of withdrawal by clicking.
Here the customer has an overview of his order as well as the delivery and billing address.
Once the customer has confirmed the terms and conditions, cancellation policy and data protection by clicking on them, he can complete the order by clicking on the "Submit order" button.
5.1.5 If the customer has selected direct debit or credit card as the payment method, an IFrame will open after the customer has submitted the order in which he must enter his account details or credit card details.
5.2 Acceptance by the Seller shall be subject to clause 2.3 of the Seller’s General Terms and Conditions (see above).
6 Information on the storage of the contract text
The contract text will be saved by the seller and sent to the customer after the order has been submitted, along with these General Terms and Conditions and customer information, in text form (e.g., by letter, fax, or email). In addition, the contract text will be archived on the seller's website and can be accessed free of charge by the customer via their password-protected customer account by entering the relevant login data, provided the customer has created a customer account in the seller's online shop before submitting their order.
7 Information about the technical means to detect and correct input errors
Before submitting the order, the customer can continuously correct their entries using the usual keyboard and mouse functions. Furthermore, all entries are displayed again in a confirmation window before the order is submitted, where they can also be corrected using the usual keyboard and mouse functions.
8 Information on the languages available for the conclusion of the contract
Only the German language is available for the conclusion of the contract.
9 Information on codes of conduct to which the seller has submitted
9.1 The Seller has submitted to the Trusted Shops GmbH Code of Ethics, which is available online at http://www.trustedshops.de/shopbetreiber/qualitaetskriterien.html.
